Wybrane aspekty problematyki współtwórczości utworów naukowych
Abstrakt
Co-authorship of scientific works is an important issue, both from the point ofview of copyright rules and practices for determining scientific works by academicactivity. The fact that the co-authors of scientific papers indicate not only theircreators under copyright law, but also those who are complicit in obtaining scientificresults, should be regarded as justified and particularly so as more and more scientificresearch is being conducted by separate teams working in collaboration with eachother. It seems that, subject to certain conditions being met, the position should beaccepted according to which “non-statutory” determination by scientific works canbe reconstructed based on the provision of art. 23 of the Act of 23 April 1964 – CivilCode,The scientific community should widely accept the practice of including asco-authors those involved in developing the research.The nature and scope ofcollaboration may vary and this too requires to be taken into consideration. It shouldalso be noted that determining co-authorship of scientific publications involvesaccruing scientific scores which may affect the size of credits for publication. Sucha situation would justify universitiesadoptinginternal guidelines and tips to enableauthors to assess and evaluate their contribution to a common scientific work.Pobrania
